THE APPELLATE TRIBUNAL :    
  
  
Vide order dated 24.4.2024, Learned Counsel for 
Appellant made a statement that the Appellant is willing to 
settle the matter for an amount of Rs.8,50,000.00 which is  
duly been accepted by the Bank. 
 
Learned Counsel for Appellant submits that the 
Appellant has already made payment of Rs.85,000.00 
towards upfront amount.  Today Rs.5.00 lac is deposited 
through cheque in the Bank.  It is further submitted that 
Rs.2.00 lac is deposited with the Registrar, DRAT as        
pre-deposit which may be permitted to be withdrawn so that 
he could deposit the same with the bank. Further remaining 
Rs.75,000.00 will be deposited within seven days. Factual 
matrix of the matter is not disputed by the Learned Counsel

On the basis of the statement made by the Learned 
Counsel for Appellant, appeal stands disposed of with the 
following directions : 
1. 
Cheque of Rs.5.00 lac, deposited through cheque by 
 
Appellant, be encashed by the Bank.   
2. 
Appellant should withdraw Rs.2.00 lac from the 
 
Registrar, DRAT and deposit with the Bank within seven 
 
days from today. 
3. 
Appellant 
should 
deposit 
Rs.75,000.00 
with 
the 
 
Respondent Bank within seven days. 
 
In case of default in either of the above conditions, this 
order shall stand in-operative and appeal shall stand 
dismissed. 
 
Copy of the order be supplied to Appellant and the 
Respondents and a copy be also forwarded to the concerned 
DRT. 
 
File be consigned to Record room.  
 
Order  dictated, signed, dated and pronounced in open
