THE APPELLATE TRIBUNAL :
Learned Counsel for the Appellant submits that account
has been settled and the Appellant is withdrawing the
Appeal. It is further submitted that ‘No Due Certificate’ has
been issued by the Bank. A prayer is made by the Ld.
Counsel for the Respondent that the Appellant may be
directed to provide the statement of Account which is an
innocuous prayer. When the account is settled, Bank is
under an obligation to provide the statement of Account.
Statement of Account is provided today. Accordingly,
Appeal is dismissed as withdrawn.
Pending I.A.s if any, are disposed of accordingly.
Interim order, if any, stands vacated.

Copy of the order be supplied to the Appellant and the
Respondent and the copy be also forwarded to the
concerned DRT.
File be consigned to Record Room.
