THE APPELLATE TRIBUNAL :
One Mr. Ramanathan Krishna Iyer appears virtually on
behalf of the appellant. This appeal is filed by M/s Citiwide
Financial Services Ltd.
Vide order dated 12.02.2025 Mr.
Ramanathan Krishna Iyer was directed to appear physically and
to show as to how he is entitled to appear in person on behalf of
the appellant company? Vide order dated 14.02.2025 appellant
was directed to appear physically. On the last date on 10.03.2025
it was ordered that appellant should appear physically failing
which appeal shall be disposed of at admission stage. Even today
order of the Tribunal is not complied with.
2.
Today Mr. Ramanathan Krishna Iyer appearing virtually
submits that appellant may be permitted to withdraw the appeal.
Without filing any affidavit to that effect appellant cannot be
permitted to withdraw the appeal.

3.
However, it appears from record that appellant is simply
lingering the proceeding on some pretext or the other. In such
circumstances, I find it appropriate to dismiss the appeal at the
admission stage.
