THE APPELLATE TRIBUNAL :
 Heard learned counsel for the parties and perused the 
records. 
It appears from the order sheet dated 18.10.2023 that the 
matter was listed on 14.02.2024.  However, matter was wrongly 
listed on 29.01.2024 and on that date learned counsel for the 
appellant was not present.  Appeal was dismissed in default. 
Hence, instant Misc. application was filed for restoration of 
Appeal No. 44 of 2023.  I find the ground taken in the application 
is sufficient to restore the appeal. Mis. Appeal Dy. No. 197 of 
2024 is allowed.  Accordingly, appeal No. 44 of 2023 is restored 
to its original file and number. 
List on 29.04.2024 for hearing of the appeal.
