THE APPELLATE TRIBUNAL :
As per the order dated 9.4.2024, Appellant was
directed to make 30% pre-deposit of Rs.26.14 crore. The
Appellant was directed to make pre-deposit within six
weeks. But, till now, no pre-deposit is made despite the fact
that request for extension of time, made by the Appellant,
was granted on 9.7.2024. Today again Learned Counsel for
Appellant prays for extension of time. However, keeping in
view the fact that the order for pre-deposit was passed on
9.4.2024 which has yet not been complied with, I do not find
any ground to further extend the time. Accordingly, the
request for extension of time is declined. Consequently, the
appeal is not maintainable for want of pre-deposit.
Accordingly,
the
instant
appeal,
being
Diary No. 864 of 2023, is dismissed.

Copy of the order be supplied to Appellant and the
Respondents and a copy be also forwarded to the concerned
DRT.
File be consigned to Record room.
