THE APPELLATE TRIBUNAL :
MA. Dy. No. 290 of 2023 is filed by the appellant for 
recalling of the order 30.03.2023 and restoration of Appeal Dy. 
No. 05 of 2023.  
Heard learned counsel for the parties.  Learned counsel for 
the appellant submits that advocate on record could not appear 
on 30.03.2023 due to certain medical ground. 
Having heard learned counsel for the parties I find that the 
ground explained in the M.A. is sufficient for recalling the order 
dated 30.03.2023. 
In view of the above, order dated 30.03.2023 is recalled.  
MA. Dy. No. 290 of 2023 is allowed.  Appeal Dy. No. 05 of 2023 is 
restored to its file and number. 
Let paper book be served upon the respondent within three 
days.  Opposition be filed within three weeks with advance copy 
to the appellant who may file rejoinder within a week thereafter. 
List on 24.08.2023 for disposal of I.A. 03 of 2023 .
